Terms of Service

1. Acceptance of Terms

By accessing or using GetCapi's server-side tracking platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

GetCapi provides a managed server-side Google Tag Manager (sGTM) hosting platform that enables businesses to collect and process first-party data for marketing analytics and attribution purposes.

3. Account Registration

To use our Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Be at least 18 years old or have legal authority to enter contracts

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Collect data without proper consent where required
• Transmit malicious code or interfere with the Service
• Attempt to gain unauthorized access to our systems
• Resell or redistribute the Service without authorization

5. Data Processing

You acknowledge that you are the data controller for any personal data processed through our Service. You are responsible for ensuring you have appropriate legal bases and consents for data collection. We act as a data processor and will process data only according to your instructions and our Data Processing Agreement.

6. Service Level Agreement

We commit to 99.9% uptime for our Service. Scheduled maintenance will be communicated in advance. Service credits may be available for qualifying downtime events as detailed in our SLA documentation.

7. Pricing and Payment

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days notice.

8. Intellectual Property

The Service, including all software, designs, and documentation, is owned by GetCapi and protected by intellectual property laws. You retain ownership of your data and configurations.

9. Limitation of Liability

To the maximum extent permitted by law, GetCapi shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

10. Termination

Either party may terminate this agreement with 30 days written notice. We may suspend or terminate your account immediately for violation of these terms. Upon termination, you may export your data within 30 days.

11. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.

12. Governing Law

These terms shall be governed by the laws of Norway. Any disputes shall be resolved in the courts of Oslo, Norway.
